Nepal approves new constitution

Nepal has approved a new, temporary constitution to bring former rebel Maoists into an interim parliament and strip the king of his executive powers in favour of the prime minister.

The speaker of the lower house of parliament says the proposed interim constitution has been unanimously approved after no 'nays' were heard during voice voting.

The new parliament with 83 former rebel members is due to meet for the first time later today.

SC judges make 13-point recommendation on draft interim constitution

A full court meeting of the Supreme Court justices on Sunday came up with a 13-point recommendation for amendment in the draft of the interim constitution.

Concluding that some of provisions in the draft interim constitution run counter to the concept of the independence of the judiciary, the meeting decided to submit the recommendations to the Prime Minister.

The proposal states that the Chief Justice be appointed with the recommendation of the Constitutional Council, not by the Prime Minister as mentioned in the draft of the interim constitution finalised by the eight parties on December 16. The judges have also argued that the CJ should be named as the 'CJ of Nepal' instead of the 'CJ of the Supreme Court'.

The judges have also opposed the provision in the draft interim constitution, which bars retired judges from getting political appointments as well as the provision of impeachment of judges if they are found with mental or physical inability.

Similarly, another recommendation says that the provision of submitting the annual report of the judiciary to the Prime Minister, who will then present it to the parliament, be changed as it is against the concept of judicial independence. The report, it is proposed, should be publicised directly without submitting it to the Prime Minister.

CJ Dilip Kumar Poudel and most of the SC judges were present at the two-and-half-hour long meeting held at the Supreme Court. The judges had been discussing these issues since Thursday.

प्रहरी चौकी पुनर्स्थापना गर्न सरकारी सकृयता

विस्थापित प्रहरी चौकीहरु पुनर्स्थापित गर्ने कार्य सक्दो छिटो अघि बढाउन आफुहरु लागिपरेको अधिकारीहरुले जनाएका छन्।

माओवादी अध्यक्ष प्रचण्डले देशभरि प्रहरी चौकी पुनर्स्थापना गर्ने र गाउं विकास समितिहरुको काम संचालनमा बाधा व्यवधान नपु-याउन आफ्ना कार्यकर्तालाई निर्देशन दिएको एक दिनपछि सरकारी अधिकारीहरुको त्यस्तो भनाइ आएको हो।

दश वर्ष पुरानो माओवादी सशस्त्र द्वन्द्वका क्रम झन्डै १९ सय प्रहरी चौकीहरुमध्ये १३ सय जति विस्थापित हुन पुगेका थिए।

बुधवार आफ्ना कार्यकर्ताहरूलाई जारी गरेको निर्देशनमा प्रचण्डले मधेशमा तत्काल र पहाडमा सल्लाह अनुसार प्रहरी चौकी पुनर्स्थापना गर्न सरकारलाई सहयोग गर्न भनेका थिए।

त्यस्तै गाविस सचिवहरुलाई चुनाव सम्बन्धी काम गर्न दिन र अन्य दलका कार्यकर्ताहरूलाई निर्विवाद रुपमा राजनीतिक प्रचार गर्ने वातावरण बनाउन समेत सहयोग गर्न आफ्ना कार्यकर्ताहरूलाई निर्देशन दिएका थिए।

कोइरालाको चेतावनी

ती कामहरू गर्न नदिएर संविधानसभाको चुनावको तयारीमा बाधा पु-या‌एको आरोप माओवादीहरूले खेप्दै आएका थिए।

यसै साताको शुरुमा स्वयं प्रधानमन्त्री गिरिजाप्रसाद कोइरालाले नै चेतावनीपूर्वक त्यस्तो आरोप लगाएका थिए।

बिहिवार बीबीसीसंग कुरा गर्दै गृह मन्त्रालयका प्रवक्ता वामनप्रसाद न्यौपानेले यही पौष १८ गतेसम्म देशका विभिन्न ठाउंमा ३३६ वटा प्रहरी चौकीहरु पुनर्स्थापित गरीसकिएको जनाए।

पौष २५ गतेभित्र तराईका सबै प्रहरी चौकीहरु पुनर्स्थापित गरीसक्ने र पहाडी क्षेत्रमा पनि त्यसैको दुई-चार दिन भित्रमा गरीसक्न सरकारले निर्देशन दिएको न्यौपानेले बताए।

सशस्त्र द्वन्द्वका क्रममा देशका झन्डै चार हजार गाविस भवनहरुमध्ये २,१०० भवनहरु क्षतिग्रस्त भएका अधिकारीहरु बताउंछन्।

ती मध्ये कतिपय भवनहरु मर्मत, संभार गरिएका र अन्यत्र चाहिं घर भाडामा लिएर पनि गाउं विकास समितिको कामकाज संचालन गरिने स्थानीय विकास मन्त्री राजेन्द्र पाण्डेले बताए।

उनले मतदाता नामावली संकलन गर्न र नागरिकताको सिफारिसका लागि पनि ती कार्यालयहरु संचालन हुनै पर्ने बताए।

मन्त्री पाण्डेले ३४३ वटा गाविस कार्यालयहरु अझै कर्मचारीविहिन रहेको र सरकारले त्यहां छिट्टै कर्मचारीहरु पठाउन लागेको पनि बताए।

आउंदो जेठ महिनाभित्र संविधान सभाको चुनाव गराइसक्ने बताउंदै आएको सरकारले यही माघ एक गतेदेखि मतदाता नामावली संकलन कार्य शुरु गरिने घोषणा गरेको छ।

तर अन्तरिम संविधान, अन्तरिम संसद र अन्तरिम सरकार गठनजस्ता महत्वपूर्ण कार्यहरु अझै बांकी नै रहेकाले तोकिएको समयमा चुनाव हुने कुराप्रति भने आशंका कायमै छ।

Maoists will be responsible if CA polls are not held on time: PM Koirala

Prime Minister Girija Prasad Koirala has warned that the constituent assembly polls would not be held within the stipulated timeframe if the Maoists continue to oppose the re-establishment of police posts and return of the VDC secretaries.

Before his return to the capital on Monday after five days' rest in his hometown Biratnagar, Koirala told reporters at his residence that he has already talked with Maoist chairman Prachanda and second in command Dr Babu Ram Bhattarai, who agreed to allow the re-establishment of the displaced police posts and return of the VDC secretaries to facilitate the process of collecting voters' name list and distribution of the citizenship.

Meanwhile. Koirala reiterated his stand not to withdraw the proposed names for ambassadors. He stated the names were proposed after discussion with all parties.

In another context, the PM again said handing over more power to the prime minister would make the post autocrat.
